they wont pay me!!!!

hi all

iv just had a letter from my employer saying thay wont be paying me SMP because i have not earnt enough!

what happens now, what can i get? they sent me my MAT B! form back

    You should be able to get maternity allowance! I get it because I hadnt worked for my emloyer long enough. Check ou this link it will tell you about it. http://www.jobcentreplus.gov.uk/JCP/Customers/WorkingAgeBenefits/Dev_008115.xml.html
    You can get child benefit aswell. You might also be able to get childtax and working tax credit. Try looking on www.dwp.gov.uk

    Don't worry, you will be able to get something!

  • Hi luv you need to go into the local job centre and talk to someone there as you have worked within 66wks before you conceived you will be entitled to maternity allowance this will be 90percent of your earnings over a 13 weeks period which you choose from within the 66 wks (so choose your highest payed time) if it exceeds ??108.85 then it will capp off there as the highest amount is roughly ??108.85 per week you can claim this from 11 weeks before baba is due too would be best to go and speak to someone and get appropriate forms tho as it has been a couple of years since i did it and some things may have changed slightly good luck Sophie 39+1 xx

  • Can you ring the job centre plus helpline to get some advice to what you might be entitled to or website here has some info on maternity allowance etc.

    I was c/minding and classed as self employed and will get maternity allowance at about ??117.00 week or something. Loads of forms to fill in though.

    I know it gets confusing about how many weeks etc. you have to have worked before your e.d.d ...etc. best to discuss with them...

  • hello, smp is to do with not working enough weeks rather than not earning enough money. If you cant claim SMP, you can claim maternity allowance. Phone up job centre plus and they will send you a pack out including all the necessary forms and how to fill the form in. Your work will also need to provide you with an SMP1 form which is a form which states why you cant claim smp. The amount has now gone up so you earn something like ??117.18 per week or 90% of your current earnings, whichever is greatest.The only difference to smp is that you miss out on the first few weeks where you would have got paid by your company. Its more than what you would get if you were not working at all. The form will also highlight whther you are legible for smp or not. When I got mine the form stated that i may have been legible for it although i was certain i wasnt as i hadnt been there long enough. The final answer was I wasnt legible, but worked still looked into it for me. all the best. Im currently in the process of sorting mine out. Just need to find an old wage slip!

  • Sorry - I've edited my answer, I was wrong before. Just pasted this from the Department of Work & Pensiosn website:

    To get SMP you must have been:
    * Employed by your employer into the qualifying week which is the 15th week before the week your baby is due.
    * Employed by the same employer without a break for at least 26 weeks into the 15th week before the week your baby is due. Part weeks count as full weeks, and
    * Earning before tax an average of ??87.00 a week. This is called the Lower Earnings Limit for National Insurance Contributions (NI) and is the amount you have to earn to qualify for benefits. You have to earn more than this amount before you actually start paying NI.
    If YES to all, claim SMP.

    Too try and put your mind at rest if you don't get SMP you will get maternity allowance. I copied this for government website.

    You might get Maternity Allowance if:

    you're employed, but not eligible for Statutory Maternity Pay

    You may be eligible if:

    you've been employed and/or self-employed for at least 26 weeks of the 'test period' (66 weeks up to and including the week before your baby is due). Part weeks count as full weeks; and
    you earned ??30 a week averaged over any 13 weeks in your test period
    More information can be found in the leaflet NI 17A 'A Guide to Maternity Benefits'

    Maternity Allowance pays a standard weekly rate of ??117.18 or 90 per cent of your average gross weekly earnings (before tax), whichever is the smaller.

    MA is paid for a maximum of 39 weeks.

    just wondered - if you'd had time off sick for any reason - still on full pay - does this effect your ability to claim SMP?

  • To qualify for Statutory Maternity Pay you must have been:

    employed by the same employer continuously (some breaks do not interrupt continuous employment) for at least 26 weeks into the 15th week before the week your baby is due; and
    earning an average of at least ??90 a week (before tax)
    If you can't get Statutory Maternity Pay, (from any of your employers if you have more than one) you may be able to get Maternity Allowance instead.


    secret mama - it shouldn't because you are still classed as employed even if you are on sick leave
  • I couldn't get smp as I hadn't returned to work after having having my 1st baby and was still on maternity leave (unpaid). I went to jobcentre and got form to claim maternity allowance and they are now paying me that. The form has all the info you need- and just to let you know you can claim it even if you weren't physically at work but you were classed as an employee (eg if you were on paid sick leave or maternity leave). But be warned, do it early cos takes a while for them to sort it out).
